What is a Virtual Bankruptcy Assistant (VBA)?
A Virtual Bankruptcy Assistant is an independent contractor who works for bankruptcy attorneys by gathering the necessary information from the Client Intake Forms and drafting Chapter 7 & Chapter 13 Bankruptcy Petitions. When petitions are prepared in an attorney’s office, there are often interruptions from phone calls and clients coming into the office, and this can cause mistakes or omissions on the forms.
As trained VBAs working from a home office, we can focus exclusively on drafting the petition with fewer interruptions, which allows the work to be done in less time with fewer errors and more accurate results. A VBA does not need to be a paralegal - drafting a bankruptcy petition is not normally a job that falls under the category of paralegal duties. In fact, paralegal schools do not include specific training on the proper drafting of a bankruptcy petition.
Does this constitute UPL (Unauthorized Practice of Law)?
No, because there is no sharing of fees with the attorney. The debtor pays the attorney directly for his (or her) representation. We are simply gathering information and processing the paperwork, just as an in-house employee would do, but working instead as an independent contractor. We do not give clients any advice, but will pass on any questions the client asks to the attorney or refer the client directly to the attorney. We work strictly for the attorney, not the general public.
How does the process work?
We provide the attorney with free Client Intake Forms, which the attorney gives to the client to fill out and return to him (or her). After reviewing them, the attorney faxes or emails the completed forms to us, and we take the information and draft the petition.
We contact the client (if we have the attorney’s permission) to gather any missing information or clarify any questions in order to accurately complete the petition. We conduct research to obtain and document market value of all motor vehicles, as well as gather information from lien searches. If a criminal or civil search is needed, we can do that, too.
We also fill out a cover sheet to the attorney, bringing to his attention any potential problems, such as unexempt property, which will assist him and protect his practice. The petition draft is submitted to the attorney for review in PDF form; any revisions are made and the final completed petition is returned to the attorney for filing, or we can file it electronically if the attorney prefers.
